Terms and Conditions Governing Online Booking and Payment
These terms and conditions (“Terms”) shall apply to and be binding upon every user, visitor, or prospective customer, whether an individual or an entity (“User”, “You”, or “Your”), of CollarEV Auto India Private Limited (“CollarEV”, “Collar.EV” or “Collar”), who accesses or uses the website www.collarev.com
(“Platform”) for the purpose of making payment of the booking amount in accordance with the selected payment plan (if applicable) for a specific colour and model of CollarEV’s electric motorcycle (hereinafter referred to as the “CollarEV Vehicle”).
The online booking facility is offered only on the condition that the User agrees to and accepts these Terms.

1. TERMS AND CONDITIONS
The User hereby represents, agrees, acknowledges, and confirms that the User:
(i) holds a valid driving licence issued under the Motor Vehicles Act, 1988;
(ii) is legally permitted to own a vehicle in the jurisdiction of purchase;
(iii) is capable of understanding the contents of these Terms; and
(iv) has read, understood, and agrees to be bound by these Terms by selecting the acceptance checkbox.
The User acknowledges that the images and colour representations displayed on the Platform are indicative in nature and meant to represent the actual CollarEV Vehicle. While CollarEV has made reasonable efforts to ensure accurate depiction, the actual appearance and colour of the vehicle may vary depending on the purchased model and cannot be guaranteed.
Where the booking or purchase is made on behalf of another individual, the User shall provide the necessary details of such individual, and the relevant documents of that individual must be presented at the dealership.
The User confirms and declares that the information provided on the Platform for booking the CollarEV Vehicle is true, correct, and complete, including but not limited to:

Full Name
Mobile Number
Email Address and City

The User agrees and understands that the information provided shall be used by CollarEV and the authorized dealership for communication purposes.
All procedures related to the purchase of the CollarEV Vehicle, including but not limited to vehicle registration, shall be completed at the respective dealership. The sale and delivery of the vehicle shall be subject to compliance with all applicable statutory requirements and submission of necessary supporting documents, the originals of which must be produced at the dealership. In the event of non-compliance by the User, the booking or purchase amount shall be refunded without interest. The User warrants possession of all required documents.
Applicable to Users Making a Pre-Booking:
The User understands and agrees that the pre-booking amount shall be adjusted against the selected payment plan. Upon confirmation of the booking, the User shall be required to pay the remaining balance as per the CollarEV Plan chosen.

2. ACCEPTANCE OF BOOKING
Upon successful payment of the booking amount in accordance with the selected plan:
• The User must complete document verification at least seven (7) days prior to the scheduled delivery at the dealership.
• If the User fails to make payments on time as per the selected CollarEV Plan and as confirmed by the lending partner, CollarEV reserves the right to disable access to the CollarEV Vehicle and restrict its usage until payment obligations are fulfilled. Continued non-payment may result in repossession, where applicable under the CollarEV Plan.
The booking amount is processed through a third-party payment gateway, and the User shall be governed by the terms and conditions of such gateway. CollarEV shall not be responsible for any failure, error, incorrect payment, or inaccuracies arising from third-party payment service providers.

3. BOOKING TERMS
CollarEV reserves the right to modify vehicle specifications, standard features, accessories, introduce new variants or versions, or discontinue existing ones without prior notice.
CollarEV shall not be liable for any delay, loss, or failure in receipt of online booking information or submissions beyond the scope of this Platform.
CollarEV may, at its discretion, change the dealership assigned for sale and delivery of the vehicle, and such change shall be communicated to the User via email or message.
Regardless of the payment method selected, the tentative delivery timeline and waiting period shall be communicated either before or after receipt of the pre-booking request. Users seeking priority delivery are encouraged to complete KYC (where applicable) and required documentation at the dealership at the earliest, subject to vehicle availability.
The vehicle price applicable shall be the price prevailing on the actual date of delivery.
The tentative delivery slot provided is subject to change without prior notice at the sole discretion of CollarEV.
Bookings may be cancelled within ninety (90) days from the booking date by contacting an authorized CollarEV dealer, and refunds shall be processed in accordance with company policy.
Cancellations requested after ninety (90) days shall not be permitted, and the booking amount shall stand forfeited if the customer declines delivery.

REFUND POLICY
The User may cancel the booking prior to delivery. Refunds shall be credited to the original payment source within seven (7) to ten (10) working days. Pre-booking cancellations can be requested via phone or email at info@collarev.com

4. COMMUNICATION
The User acknowledges that internet-based transmission of information is not entirely secure and may be subject to unauthorized access, alteration, fraud, errors, or incomplete delivery. CollarEV shall not be held liable for any direct or indirect loss or damage arising from such risks.
The User authorizes CollarEV to share booking-related information with its dealerships, group companies, and third-party agents as necessary to facilitate booking, delivery, financing, or related services. The User agrees not to hold CollarEV or its affiliates liable for such use or sharing of information.
By providing contact details, the User consents to receive communications, including promotional messages, from CollarEV, its affiliates, and representatives through calls, SMS, WhatsApp, or email, and waives any objection under applicable TRAI regulations regarding unsolicited communications.
The User agrees to maintain confidentiality of booking credentials and order details. Any misuse or unauthorized transactions shall be the sole responsibility of the User, and CollarEV shall not be liable for resulting losses or damages.

5. GENERAL TERMS
As per Government regulations, submission of an Aadhaar Card is mandatory to avail subsidies under Phase II of the FAME II scheme. Each Aadhaar number may be used only once, and prior availing of the subsidy renders the User ineligible.
CollarEV reserves the right to amend or modify these Terms, processes, or offers at any time without prior notice.
In the event of the User’s demise, the booking shall stand cancelled and the booking amount refunded in accordance with CollarEV’s refund policy.
The User agrees to indemnify and hold harmless CollarEV, its lending partners, and dealerships against any loss or dispute arising from User negligence, breach of law, or non-compliance.
For non-individual Users, delivery shall be made only to the authorized signatory who placed the booking.
The User agrees to defend, indemnify, and hold CollarEV harmless from all claims, damages, costs, and expenses arising from use of the Platform.
Unless expressly stated otherwise, the Platform and its contents are intended solely for promotion of CollarEV products and services.
All disputes arising from bookings or Platform usage shall be subject to the exclusive jurisdiction of the competent courts in Delhi.
CollarEV may amend these Terms or suspend or discontinue online booking services without prior notice.
Failure to accept any of these Terms shall result in ineligibility for vehicle booking.
Booking the CollarEV Vehicle under these Terms is optional, and the User may choose not to proceed with the booking.
